Terms of service
Last updated 16 October 2026
These terms apply to businesses that use Krate, and to their staff who sign in to its console. They are short on purpose. If your business signed an order form or a pilot agreement with us, that agreement wins wherever it differs from these terms.
Who these terms are between
Krate (“we”, “us”) is run from India. “You” means the business that uses Krate. When you sign in to or use Krate, you accept these terms for your business and confirm that you may accept them for it.
What Krate does
Krate calls and messages your leads on WhatsApp through an AI agent that acts for you. It answers their questions, finds out who is ready to buy, books site visits, and shows every conversation and its result in the console. Some features are in pilot, and we tell you which.
Your account
- Invite only your own staff and people who work for you.
- Keep sign-ins private, and tell us at once if you think one has been misused.
- You are responsible for what happens under your business’s account.
Your leads and their consent
- You decide which leads Krate contacts. You must have each lead’s consent, or another lawful reason, to call and message them, as the Digital Personal Data Protection Act, 2023 (the DPDP Act), the Telecom Regulatory Authority of India’s (TRAI’s) rules for commercial calls and messages, and Meta’s WhatsApp policies require.
- Give us only data that you have the right to share with us.
- You are the Data Fiduciary for your leads’ data, and we are your Data Processor: we use it only to provide Krate to you, as our privacy policy describes.
Acceptable use
You must not use Krate to:
- contact anyone who asked not to be contacted, or anyone you have no right to contact;
- send false, misleading, harassing or unlawful messages;
- break Meta’s WhatsApp Business policies or any law;
- reach another business’s data, or probe, copy or disrupt our systems without our written permission.
Krate stops messaging any lead who asks it to stop. We may pause your messages, or your account, if your use breaks these terms or puts our access to WhatsApp at risk, and we tell you why.
The AI agent
The agent is an AI and can make mistakes. Give it correct facts about your projects, such as prices, offers and dates, and keep them up to date. Check what matters before you rely on it. You are responsible for the offers made in your name.
Fees
You pay the fees in your order form or pilot agreement. Fees do not include taxes such as GST, which we add as the law requires.
Your data
- Your data stays yours. We use it only to provide and support Krate for you, and as the law requires.
- We never use WhatsApp data to train or improve AI models.
- When you leave, you can export your data first. We then delete it, as our agreement with you sets out.
Our service
We work to keep Krate running, but we cannot promise that it will never be interrupted or never be wrong. We may change features, and we tell you before we remove one that you use.
Liability
Neither of us is liable to the other for indirect or consequential losses, such as lost profits. Our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits a liability that the law does not allow to be limited.
Ending these terms
You can stop using Krate at any time, subject to your order form. We can end these terms with 30 days’ notice, or at once if you seriously break them.
Changes to these terms
We may update these terms. We tell you at least 30 days before a change that matters takes effect, and the date at the top changes. If you keep using Krate after that, the new terms apply.
Law and disputes
The laws of India govern these terms. The courts where our registered office is have jurisdiction over any dispute about them.
